У статті на основі аналізу вітчизняного законодавства, окремих міжнародних нормативно-правових актів, думок правників визначено сутність інституційної спроможності судової системи України як здатності ефективно та прозоро виконувати свої функції через забезпечення належного рівня нормативного регулювання, а також структурних, організаційних, кадрових та технічних систем, процесів та ресурсів. Зазначено, що її елементи є сукупністю характеристик, що забезпечують ефективну діяльність та дозволяють досягати мети функціонування.
