З проголошенням України незалежною державою питання щодо правового статусу іноземців стало досить актуальним та часто досліджуваним серед науковців. Певні прогалини законодавства породжують деякі проблеми взаємодії держави та іноземців, що може спричинити обмеження невід’ємних прав і свобод іноземців. У статті проаналізовано правовий статус іноземців на підставі дослідження науковців та законодавства задля ширшого розуміння. Окрім цього, запропоновано шляхи розв’язання проблем. У статті аналізується судова практика, як приклад того, як саме впливають прогалини законодавства на процес видворення або повернення іноземців.
